The petitioner seeks bail in connection with Pasraha P.S. Case No. 113 of 2018 for the offence under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act and also 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, several accused persons have been granted regular bail by different co-ordinate Benches of this Court in Cr. Misc. No. 70641 of 2018 and Cr. Misc. No. 75417 of 2018 and the case of this petitioner

Patna High Court Cr.Misc. No.78598 of 2018(2) dt.25-01-2019 2/2 stands on better footing to those who have been granted regular bail as nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in custody since18.09.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned In-Charge, Special Judge, Excise Act, Khagaria in connection with Pasraha P.S. Case No. 113 of 2018/G.R. No. 2581 of 2018.
