JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Heard learned counsels for the petitioner and the State. The petitioners being the parents of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A and 315/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of the dowry demand and getting the pregnancy terminated. It is submitted by learned counsel for the petitioner that earlier also Pipra Kothi P.S. Case No. 74 of 2012 and Complaint Case No. 294 of 2013 were filed with similar accusation. Though, the complaint is under enquiry but the petitioners are on bail in
Patna High Court Cr.Misc. No.47333 of 2015 (3) dt.12-10-2015 2/2 Pipra Kothi P.S. Case No. 74 of 2012. In the present case, the investigation is concluded and final form has been submitted only under Section 498A of the IPC and Section 3/4 of the Dowry Prohibition Act.
Considering the thrust of accusation against the husband of the informant and two other cases with similar accusation already filed by the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar, East Champaran at Motihari in connection with Piprakothi P.S. Case No. 87 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
