The petitioners are apprehending their arrest in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 33 of 2017 for the offences instituted under Sections 354, 506 and 120(B)/34 of the IPC.
The prosecution story, in brief, is that on 19.01.2017 while the informant had come to the Court, one unknown boy, aged about 23 years under conspiracy, snapped her photograph with intention to kill her who was sent by the petitioner. It is further alleged that earlier also they had told to kill her under conspiracy. The said unknown boy had misbehaved and entered
Patna High Court Cr.Misc. No.28414 of 2017 (2) dt.07-07-2017 2/2 into push and pull with her.
It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioner no. 1 is the father-in-law of the informant. Petitioner no. 2 is the husband of the informant and petitioner no. 3 is the mother-in-law of the informant. Due to family dispute, the present case has been instituted to put pressure upon the petitioners.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 33/2017 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
