The petitioner apprehends his arrest in connection with Turkaulia P.S. Case No.691 of 2012, registered under Section 399 and 402 of the Indian Penal Code and Section 25(1-B)a/26/35 of Arms Act.

The accusation is that Police on receiving secret information about committing of serious offence by the miscreants raided at NH-28A at village Pacharukha, where five persons were seen and on seeing the presence of Police, they started fleeing away, while one of the miscreants was apprehended, who disclosed his name as Shyam Sahani, but other miscreants succeeded in fleeing away. The apprehended accused Shyam Sahni disclosed the name of his associates as Ravi Sahani, Uma Shankar Sahani (petitioner), Nandu

Patna High Court Cr.Misc. No.47340 of 2015 (2) dt.16-02-2016 2/2 Sahani and Krishana Sahani and at some distance two country made pistol were also found on the place of occurrence. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended on spot; rather, his name has been disclosed by coaccused Shyam Sahani, who is said to be apprehended by the Police on the place of occurrence. The petitioner has no criminal antecedents. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S. Case No. 691 of 2012, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
