The petitioner apprehends arrest in Jandaha P.S. Case No. 43 of 2013 dated 01.03.2013 instituted under Sections 395/412 of the Indian Penal Code.

After some arguments, learned counsel for the petitioner seeks permission to withdraw the application in order to surrender and pray for bail before the Court below in view of similarly situated co-accused Sanjay Kumar Sahani having been granted bail.

In view of the aforesaid, the application stands disposed off as withdrawn with the liberty aforesaid.

It goes without saying that the Court below shall consider the case in accordance with law on merits taking into account all

Patna High Court Cr.Misc. No.47854 of 2015 (3) dt.09-11-2015 P2/2 materials available to the petitioner including that of similarly situated co-accused having been granted bail, without being prejudiced by the present order.
