The petitioner is apprehending his arrest in Nawanagar P.S. (Sonbarsa O.P.) Case No. 46/2014 registered for offences punishable under Sections 147, 149, 447, 448, 341, 323, 353, 504 & 506 of the I.P.C.
The prosecution case has been lodged by the Branch Manager of UCO Bank, Sonebarsa alleging therein that on 21.02.2014, the petitioner came to the Bank at 12.30 P.M. and withdrew a sum of Rs. 3,19, 487/- from his Bank account and went away. Again at 1.30 to 1.45 P.M., the petitioner came with 10-12 persons armed with lathi and started assaulting the informant and Shambhu Kumar, Cashier with fists and blow.
Patna High Court Cr.Misc. No.30179 of 2014 (5) dt.01-07-2015 2/3 The informant has also stated in his fardbeyan that the petitioner and other persons also threatened to kill the informant and other officers and on information, the police also arrived.
Learned counsel for the petitioner has drawn my attention to Annexure-2 stating therein that he had earlier lodged a case as Nawanagar (Sonebarsa) P.S.Case No. 45/2014 against looting amount of Rs. 3, 19, 385/- which was withdrawn from the Bank where informant is Branch Manager and it was not possible for him to reach the Branch within fifteen minutes from the distance of 15 K.M. when the key of the motorcycle was also snatched by the miscreants.
Learned counsel for the A.P.P. submits that the investigation is going on.
From perusal of the case diary at paras -25 and 26, which is injury report, it appears that the injury is simple, caused by hard and blunt substance.
Considering the facts stated above, the petitioner Sushil Kumar Singh, be released on anticipatory bail in the event of arrest or surrender before the learned Court below within two weeks from the date of receipt/ production of the order on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two
Patna High Court Cr.Misc. No.30179 of 2014 (5) dt.01-07-2015 3/3 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 46/2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
