2. The petitioners apprehend their arrest in connection with Baikunthpur P.S. Case No. 289 of 2024, instituted for the offences under Sections 80, 103(1), 238, 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 3 / 4 of D.P. Act.
3. Prosecution case, in short, is that sister of the informant was done to the death by the petitioners along with other co-accused persons for non-fulfillment of dowry.
4. Learned counsel for the petitioners submitted that the petitioners have falsely been implicated in the present case. Charge-sheet has been submitted in this case. Petitioners are mother-in-law and father-in-law of the deceased. The husband of the deceased has been released on regular bail by this Court
Patna High Court CR. MISC. No.25232 of 2025(4) dt.05-02-2026 2/2 vide order dated 24.07.2025 passed in Criminal Miscellaneous No. 22114 of 2025. The petitioners are separate in mess and business from the husband of the deceased. The informant is not the eye-witness of the occurrence. In fact, sister of the informant accidently fell down in the Gandak river. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case, let the petitioners above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Baikunthpur P.S. Case No. 289 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.
