JUSTICE BIRENDRA KUMAR ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Barun P.S. Case No. 85 of 2018 registered for the offence punishable under Section 379, 411, 420/34 of the Indian Penal Code read with Section 4/40 Bihar Mines Mineral Rules and Section 15 of Environment Protection Act. Allegation is of illegal mining of sand. A motorcycle was lying at the place of mining which belongs to the petitioner. Considering the nature of allegation and the statement of the petitioner that he has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the

Case No. 85 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
