JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 The petitioner being the husband of the complainant has renewed his prayer for anticipatory bail in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 504 and 498A/34 of the IPC and Section 3/4 of the Dowry Prohibition Act.

Earlier the anticipatory bail application of the petitioner was permitted to be withdrawn vide order dated 11.11.2013 passed by a co-ordinate Bench of this Court in Cr. Misc. No. 25408 of 2013.

In view of the above fact, the present anticipatory bail application is not maintainable.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six

Patna High Court Cr.Misc. No.46429 of 2015 (2) dt.05-10-2015 2/2 weeks in connection with C.A. 787 of 2010 pending in the court of learned CJM, Katihar.

Accordingly, the application is disposed of.
