Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Bagaha (Pathkhauli) P.S. Case No. 743 of 2022 registered for the offence under Sections 457, 380 and 411 of the Indian Penal Code.

The prosecution story in short is that on 23.10.2022, the informant went with her family members to Gorakhpur to meet his father. On 27.10.2022, his neighbour Hiraman Chaudhary informed him that theft has been committed in his house. After this, the informant returned to his

Patna High Court CR. MISC. No.23972 of 2023(2) dt.18-05-2023 2/3 house where he found that Jewellery, Mobile Phone, ATM Card and other house-hold articles along with Cash Rs. 60000/- was stolen by unknown thieves.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2022 and the petitioner has four antecedent.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st Bagaha, West Champaran in connection with Bagaha (Pathkhauli) P.S. Case No. 743 of 2022. The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.

The petitioner will visit Bagaha (Pathkhauli) Police

Patna High Court CR. MISC. No.23972 of 2023(2) dt.18-05-2023 3/3 Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
