The petitioner seeks regular bail in connection with Triveniganj P.S. Case No. 330 of 2018, registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.
The allegation is regarding the motorcycle of the informant having been stolen by unknown person. The learned counsel for the petitioner submits that the recovery of the motorcycle is stated to have been made from a ground where fair was taking place, however, no recovery has been made from the conscious possession of the petitioner. It is further submitted that only after the petitioner was arrested in connection with Triveniganj P.S. Case No.
Patna High Court Cr.Misc. No.79407 of 2018(2) dt.18-01-2019 2/2 301 of 2018, he has been falsely implicated in the present case and remanded in the present case. It is submitted that apart from the aforesaid case and the present case, the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 31.08.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Supaul in connection with Triveniganj P.S. Case No. 330 of 2018.
