NILU AGRAWAL ORAL ORDER 01-07-2015 Heard learned counsel for the petitioner, the informant and learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Muzaffarpur Mahila P.S.Case No. 62 of 2014 registered for the offence under Sections 498(A), 323/34 of the Indian Penal Code pending before the learned S.D.J.M (East), Muzaffarpur. Learned counsel for the petitioner submits that the petitioner is ready to keep the informant as his wife with full dignity and honour. Learned counsel for the informant submits that the informant (wife) and the petitioner are ready to live together.
Under the circumstances, both the petitioner and the
Patna High Court Cr.Misc. No.43856 of 2014 (3) dt.01-07-2015 2/2 informant shall appear before the learned S.D.J.M., (East), Muzaffarpur on 10th of July, 2015 in person, who will look into the matter and pass necessary order taking into consideration that the husband is ready to keep the informant (wife) with full dignity. If the learned S.D.J.M., (East), Muzaffarpur, is satisfied about the genuineness of the undertaking of the petitioner, he may be granted anticipatory bail . Till then the petitioner is granted provisional anticipatory bail in connection with Muzaffarpur Mahila P.S.Case No. 62/2014 for a period of two months, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., (East), Muzaffarpur. With the above observation and direction, this application is disposed of.
