JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 30-06-2016 Heard Mr. Brij Kishor Mishra, the counsel for the petitioner and Mr. M. Dayal, APP for the State. The petitioner herein seeks anticipatory bail in connection with Buxar (Ind.) P.S. Case No. 19 of 2015, registered under Sections 406, 420, 120(B) of the Indian Penal Code.

On going through the prosecution case, it appears under a conspiracy, the petitioner and others cheated the informant in the name of providing job overseas. The petitioner contacted the informant and asked him to contact with another co-accused namely, Manjeet Singh who took the informant in confidence and got deposited the amount in the Bank, whereafter

Patna High Court Cr.Misc. No.25899 of 2016 (2) dt.30-06-2016 2/2 he was called to Punjab. The travel documents such as Visa, Air Tickets given to him which were later found forged. The contention of the petitioner is that the allegation is mainly attributed to co-accused Manjeet Singh. The petitioner initially only alleged to have contacted the informant in relation to procuring him job. He deserves anticipatory bail particularly when there is no criminal antecedent.

Mr. Dayal, on the other hand, submits that on going through the First Information Report and the others material reflected from the record, it shall appear that the petitioner had hand in gloves with Manjeet Singh. Such offence of fraud & cheating is generally committed by a group of persons performing different jobs.

Considering the facts and circumstances of the case, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. The prayer is rejected.
