In this case, the petitioner is seeking anticipatory bail in connection with Islampur P. S. Case No. 88 of 2016 registered for the offences under Sections 147, 341, 323, 379, 504 of the Indian Penal Code and Section 3 /4 of the Witch Craft Act.
The allegation has been made against all the accused persons including the petitioners that when the victim was standing near her house, all the accused persons including the petitioners called her and also assaulted her. At that time, she was saved by her husband.
Patna High Court Cr.Misc. No.26716 of 2016 (2) dt.30-06-2016 2/2 Learned counsel for the petitioners submits that there is a case and counter case from both sides and there is no specific allegation against the petitioners. Leaned counsel for the petitioners further submits that the sessions court has already granted bail to the male members.
This statement will be verified by the court below as no material has been produced in support of this statement. Looking to the nature of the allegation and the petitioners are ladies, let the petitioners, named above, in the event of their arrest or surrender within four weeks from today be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 88 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
