The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A and 120B of the Indian Penal Code.

In 164 Cr.P.C. statement of the victim girl, specific allegation has been made against co-accused Krishna Devi, Vijay Sahani and Dinesh Sahani, against whom the victim has alleged that they forcibly abducted her and got her married with co-accused Dinesh Sahani against her will and in the entire statement under Section 164 of the Cr.P.C. she has not whispered about the petitioner Ruby Devi. The petitioner is a lady and has got no criminal antecedent.

In view of the aforesaid statement of the victim girl

No.21718 of 2019(4) dt.23-07-2019 2/2 under Section 164 of the Cr.P.C. and the fact that petitioner is lady, let the above named petitioner be released on bail in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-15th-cum-Additional Chief Judicial Magistrate-14, Muzaffarpur/successor Court in connection with Katra P.S.Case No.123 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
