1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Muffassil (Munger) Police Station Case No. 395 of 2024, dated 10.11.2024, disclosing offences under Sections 126(2)/115(2)/109/303(2)/352/351(2)/3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report, is that on 09.11.2024, in the evening, while the informant was at her home, the petitioner and two other accused persons started misbehaving with the informant. When the informant raised alarm her nephew arrived there upon which the petitioner assaulted the informant's nephew with butt of pistol on his head, the co-accused Kundan
Patna High Court CR. MISC. No.24949 of 2025(2) dt.05-05-2025 2/3 Mandal assaulted with iron rod and other co-accused persons assaulted him by means of lathi. It has further been alleged that the accused persons took away gold chain and mobile phones of the informant and her nephew.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to dispute regarding passage between the family of the petitioner and informant. He next submits that the petitioner is a resident of near by village and he had visited his maternal grant-mother's house in the village of the informant. Referring to the impugned order, learned counsel submits that injury report was produced before the learned Court below, but in the order it is not mentioned that the injuries are grievous in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is having no criminal antecedent and in impugned order it has not been mentioned that the injuries caused to the victims are grievous in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Muffassil (Munger) Police Station Case No. 395 of 2024, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
