05-10-2015 Heard Sri Subodh Kumar Jha, learned counsel for the petitioner.

The sole petitioner, apprehending his arrest in connection with K. Nagar P.S. Case No. 203 of 2015 registered for the offence under Sections 363, 366(A) of Indian Penal Code, has prayed for grant of anticipatory bail.

Sri Jha, learned counsel for the petitioner, while pressing the bail petition, submits that it was a case of love affairs and falsely, the petitioner has been implicated. He further emphatically argued that F.I.R. was lodged against unknown. Accordingly, he makes a prayer for grant of anticipatory bail. On perusal of the record, it is evident that F.I.R. was lodged against unknown, however; on perusal of the impugned order, it is evident that subsequently, the victim girl was recovered

Patna High Court Cr.Misc. No.46974 of 2015 (2) dt.05-10-2015 2/2 and her statement under Section 164 of the Cr.P.C. was recorded, in which, she has made specific accusation against the petitioner. In view of facts & circumstances, I do not consider the present case to be a fit case for extending the privilege of anticipatory bail.

The petition stands dismissed.

If the petitioner surrenders before the court below within a period of four weeks from today, the learned court below, without being prejudiced with this order, may examine the case of the petitioner and pass appropriate order in accordance with law. (Rakesh Kumar, J.) Anay U T
