The petitioner is the wife of co-accused Dinesh Bind who is said to have set the house of the informant ablaze on the relevant night. She has also been named in the FIR along with her husband vide Baghaila (Nokha) P.S. Case No. 49 of 2014 instituted under section 436/34 IPC. It appears from the impugned order that the informant later died of burn injuries sustained by him. On bare perusal of the FIR, it appears that the allegation of putting the house on fire is attributed to the husband of the petitioner.

Learned APP also contended on going through the FIR that the allegation of putting the house afire is attributed to the

Patna High Court Cr.Misc. No.49033 of 2015 (2) dt.03-11-2015 2/2 husband of the petitioner.

In the facts and circumstances of the case, the petitioner above named, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Rohtas at Sasaram in Baghaila P.S. Case No. 49 of 2014 on condition that one of the bailors shall be her own/close family member. In the event of framing of charge, she shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel her bail bonds.
