The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 181/188/420 of the Indian Penal Code.

Allegation against the petitioner is that he did not disclose his criminal antecedent in the nomination paper. Submission of the learned counsel for the petitioner is that the petitioner had no knowledge of any criminal case pending against him, especially the alleged case bearing Khagaria Muffasil P.S. Case No.735 of 2013. This fact would be evident from Annexure-4, which is order sheet of the aforesaid case. Considering the nature of allegation, let the

No.23253 of 2017 (4) dt.01-07-2017 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/Successor Court in connection with Khagaria (Chitragupt Nagar) Police Station Case No.108 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
