The petitioner seeks bail in a case registered under Sections 147, 148, 149, 448, 380, 447, 302, 120(B) of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in brief is that on hearing the sound of firing, the informant rushed to his house where he saw his father lying dead at the Varandah and blood was coming from his right side of the chest.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation
Patna High Court CR. MISC. No.21912 of 2019(4) dt.16-08-2019 2/2 of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 18-01-2019. Charge sheet has already been submitted. As per FIR, the main allegation is against co-accused namely Bindeshwari Rai. So far this petitioner is concerned, no specific allegation of assault is alleged against him. The informant is not an eye witness to the alleged occurrence.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Adapur P.S.
