The petitioner seeks bail in anticipation of his arrest in connection with Sheohar P.S. Case No. 48 of 2021 dated 02.02.2021 instituted for the offences under Sections 341, 323, 307, 354(B), 379 and 504/34 of the Indian Penal Code.
It has been alleged in the FIR that on the orders of one Mukund Kumar Verma, the petitioner and others assaulted the informant, his cousin and the wife of his cousin. So far as the petitioner is concerned, it is alleged that he assaulted the wife of the cousin of the
Patna High Court CR. MISC. No.35295 of 2021(3) dt.29-01-2022 2/3 informant as a result of which she got disrobed. The learned counsel for the petitioner has submitted that an absolutely false case has been lodged against him. In fact, there is a counter version of the occurrence viz. Sheohar P.S. Case No. 47 of 2021 lodged by the petitioner, alleging that the informant of the subject FIR and his associates had assaulted the petitioner and his associates.
There appears to be a dispute with respect to a land over which there is a competing claim of the parties.
The petitioner is stated to be 85 years of age and is a retired Government servant. Two of the other accused persons of this case viz. Abhishek Nath Sahay @ Abhishek Kumar @ Gulshan and Ramanuj Prasad have been granted anticipatory bail by this Court today in Cr. Misc. No. 34979 of 2021.
Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in
Patna High Court CR. MISC. No.35295 of 2021(3) dt.29-01-2022 3/3 connection with Sheohar P.S. Case No. 48 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
