2. The petitioner is apprehending arrest in connection with Lalganj P.S. Case No. 122 of 2023, registered on 14.03.2023, for the offences punishable under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

3. As per the prosecution, total recovery of 35 litres of illicit country made liquor and 60 litres of illicit raw java have been made, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner has no criminal antecedents and has been unnecessarily made an accused in the present case solely on the basis of statements made by local shepherds.

5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 1cum- Additional District & Sessions Judge, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 122 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J.) Aman Kumar/- U T
