2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that three named and some unknown accused persons committed murder of husband of informant.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused Ajeet Kumar. Except confessional statement, there is no material on record to show

It is further contended that co-accused Madhu Yadav and Anish Kumar, having similar and identical allegations, have already been granted privilege of bail by this Hon'ble Court vide order dated 03.05.2024 passed in Cr. Misc. No. 22807 of 2024 and 03.05.2024 passed in Cr. Misc. No. 23943 of 2024. Moreover, charge-sheet has already been submitted and petitioner is in custody since 22.01.2024.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation, claim based on parity and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-XIII, Rohtas at Sasaram in connection with Suryapura P.S.
