JUSTICE PURNENDU SINGH ORAL ORDER 01-05-2025 At the outset, learned counsel appearing on behalf of the petitioners submits that he seeks to withdraw the present bail application with respect to petitioners no.1 and 8.

2. Accordingly, the present bail application is dismissed as withdrawn with respect to petitioners no.1 and 8.

3. Heard Mr. Nalin Kumar, learned counsel appearing on behalf of the petitioners and Mr. Narsingh Tanti, learned APP

4. The petitioners no.2 to 7 seek pre-arrest bail in connection with Parsa P.S. Case No. 92/2024 registered for the offence(s) punishable under Sections 147, 149, 188, 341, 323, 324, 307, 353, 332, 333, 506/34 of the Indian Penal Code and Section 3⁄4 of Public Property Damage Act.

5. As per the allegation made in the FIR, the accused persons (29 named and 40-50 unknown persons) were blocking the road with dead body of one Jaipal Singh, who died due to electric shock and when the police party came and requested to remove the blockade, they started hitting the police party with bricks, stones and sticks. The crowd present there also set the road on fire and disrupted the traffic.

6. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and have falsely been implicated in the present case. General and omnibus allegation has been levelled against the petitioners and at best, petitioners can only be said to be members of the mob.

7. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

8. Considering the rival submissions made on behalf of the parties, as well as, the fact that general and omnibus

No.23041 of 2025(2) dt.01-05-2025 3/3 allegation has been levelled against the petitioners and petitioners can only be said to be members of the mob, the petitioners no.2 to 7, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Saran, Chapra in connection with Parsa P.S. Case No. 92/2024, subject to the conditions as laid down under Section 482(2) of the BNSS. (Purnendu Singh, J) Sanjay/- U T
