JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Gandhi Maidan P.S. Case No. 142 of 2023, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. The name of the petitioner transpires on the basis of confessional statement of accused namely Praveen Kumar. Petitioner is in custody since 25.02.2023.
Patna High Court CR. MISC. No.23654 of 2023(2) dt.15-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.
Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Special Judge, Excise Act, Patna in connection with Gandhi Maidan P.S.
