Petitioner who is in custody seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 354B, 406, 420, 504, 506/34 of the Indian Penal Code. Informant has alleged in her written complaint that on 29.04.2018 at 6.30 p.m., she had gone to the residence of the accused for payment of remaining consideration amount which was due against them after her husband sold their land to the accused, however, they entered into her house and assaulted and abused her and allegation against co-accused, Ranjan Kumar is that he inflicted a knife blow as a result of which her nose was cut.
It has been submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.424 of 2019(3) dt.11-03-2019 2/3 he is innocent and has been falsely implicated in this case due to ulterior movie. It has been submitted on behalf of the petitioner that Annexure-3 is the injury report from which it appears that only one incised wound has been caused upon the petitioner and there is no repetition of blow upon the Informant. Similarly, situated co-accused person Brij Singh has been granted bail by a co-ordinate bench of this Court vide order dated 07.03.2019 in Criminal Miscellaneous No. 3965 of 2019. Petitioner has got no criminal antecedent and is in custody since 24.09.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.
10,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Harsidhi P.S. Case No. 154 of 2018 G.R. Case No. 2431 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the
Patna High Court CR. MISC. No.424 of 2019(3) dt.11-03-2019 3/3 court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) ranjan/- U
