JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 302, 201/34 of the Indian Penal Code.
Allegation in brief is that petitioner step mother-inlaw, the victim and all family members of in-laws were torturing the victim for further demand of motorcycle and due to nonfulfillment, she was killed by strangulation. Learned counsel for the petitioner submits that it is not a case of making any demand and after nine years of marriage she committed suicide and referred the postmortem report. Considering the aforesaid submissions and on from perusal of postmortem report, it appears that she was died due to
Patna High Court Cr.Misc. No.30069 of 2017 (2) dt.06-07-2017 2/2 strangulation, so the prayer for anticipatory bail of the petitioner is rejected in connection with Kanti P.S. Case No.82 of 2008 pending in the court of S.D.J.M. (West), Muzaffarpur. However, if the petitioner may surrender and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order.
