The petitioners being the parents of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
Basic accusation is of torture.
It is submitted by learned counsel for the petitioners that the son of the petitioners namely Mrityunjay Kumar was abducted by the relatives of the complainant and forcibly married with the complainant for which Madhepura P.S. Case No.325/2012 was registered at the behest of the petitioners' side,
Patna High Court Cr.Misc. No.28517 of 2016 (2) dt.13-07-2016 2/2 levelling accusation under sections 365, 504 and 506 of the Indian Penal Code wherein the family members of the complainant have been charge-sheeted under sections 365, 368, 465, 323, 504 and 506/34 of the Indian Penal Code and consequently, cognizance has also been taken by the learned CJM, Madhepura, and much thereafter the present complaint has been filed.
Considering lodging of the abduction case in 2012 and the present complaint was filed in 2015, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Madhepura, in connection with Complaint Case No.298/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
