1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the present anticipatory bail application with a liberty to raise all the issues at the time of framing of charges as it has been submitted that the petitioner was appointed as a franchisee by the North Bihar Power Distribution Company Limited for collecting the electricity dues, further, the petitioner collected an amount of Rs. 7,64,366/- but an FIR came to be instituted under Section 420 read with other Sections of the IPC that the petitioner has cheated the Company by not depositing the amount collected

Patna High Court CR. MISC. No.27226 of 2016(2) dt.14-09-2023 2/2 towards electricity dues on which the learned counsel draws the attention of the Court to Annexure-2 to the quashing application to submit that the petitioner has deposited an amount of Rs. 5 lacs and odd.

3. Permission is accorded.

4. Accordingly, the present quashing application is dismissed as withdrawn.
