====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307/34 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons, including this petitioner, killed mother of informant and threw the dead body in river. Informant further sates that the reason of the alleged occurrence is that his three uncles used to demand Rs. 5,00,000/- and a motorcycle as dowry from maternal uncle through his mother and due to nonfulfillment of the same, they committed murder of mother of informant.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and have been implicated in this case only on suspicion. Informant is not an eye witness of the alleged occurrence and petitioner has falsely been implicated in this case at the instance of maternal uncle of informant. It is further submitted that police after investigation submitted final form and did not found involvement of the petitioner in the alleged occurrence and charge-sheet was submitted only against co-accused Sita Ram Yadav and this petitioner was not sent up for trial, however, differing with the

Patna High Court CR. MISC. No.23727 of 2025(3) dt.16-05-2025 2/2 same, court below has taken cognizance of the offence. Petitioner claims clean antecedent and he is in custody since 12.2.2025. Charge sheet has already been submitted.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Khaira Police Station Case No. 222 of 2018.
