Mr.J.N.Thakur ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-09-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

The petitioner Sujit Kumar is the husband of Manisha Kumari, opposite party no.2. He was granted provisional anticipatory bail vide order dated 13.02.2019. Since he could not surrender before the court below, the time was extended vide order dated 17.07.2019 for six months and it was observed that during that period once the total amount as agreed between the parties is deposited, his bail bonds shall be confirmed with the condition that both the parties will abide by the terms of agreement agreed upon them.

Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.28422 of 2022(5) dt.28-09-2022 2/2 as per the terms of the agreement, the petitioner had to pay Rs. 2,50,000/- to the opposite party no.2 which he has already paid and her belongings including ornaments have also been returned.

Learned counsel for opposite party no.2 fairly concedes that the entire amount has been received by opposite party no.2 and her ornaments have also been returned. Considering the above facts and circumstances, the learned court below is directed to confirm the bail bond of the petitioner.

With this observation, the application stands disposed of.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
