2. The petitioner has preferred this application for grant of regular bail in connection with Kawakol P.S. Case No. 440 of 2024 dated 13.12.2024 registered for the offences punishable under Section 108 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the son of the informant was in love with the daughter of the co-accused, Bhojlal Ravidas @ Bhjojal Das and on 12.12.2024 at about 2 P.M., the co-accused along with his wife came to house of the informant and threatened his son to kill. Thereafter, at night, the son of the informant committed suicide. It is alleged that due to

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in this case during the course of investigation. There is no specific allegation against the petitioner rather the specific allegation of provoking or instigating the son of the informant to commit suicide is against the co-accused persons. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.02.2025. The co-accused person has already been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 19.04.2025 passed in Cr. Misc. No. 19718 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.24434 of 2025(6) dt.03-09-2025 3/3 the like amount each to the satisfaction of learned Court concerned, J.M.-1st Class, Nawada in connection with Kawakol P.S. Case No. 440 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
