JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.03.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 93.6 litres of Bunt Bubly country-made liquor from two gunny bags kept hidden near the bridge.

Learned counsel for the petitioner submits that the alleged seizure was made from under the bridge and the petitioner was passer-by and came to be implicated when the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.03.2022, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kuchaikote P.S. Case No. 107 of 2022.
