Ms. Renu Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, including these petitioners, killed mother of informant and threw the dead body in river. Informant further sates that the reason of the alleged occurrence is that his three uncles used to demand Rs. 5,00,000/- and a motorcycle as

Patna High Court CR. MISC. No.22218 of 2025(2) dt.28-04-2025 2/3 dowry from maternal uncle through his mother and due to nonfulfillment of the same, they committed murder of mother of informant.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have been implicated in this case only on suspicion. As a matter of fact, Petitioner No. 1 is uncle of informant and Petitioner Nos. 2 and 3 are relatives of Petitioner No. 1 as well as informant. Informant is not an eye witness of the alleged occurrence and these petitioners have falsely been implicated in this case at the instance of maternal uncle of informant. It is further submitted that police after investigation submitted final form and did not found involvement of these petitioners in the alleged occurrence and charge-sheet was submitted only against co-accused Sita Ram Yadav and these petitioners were not sent up for trial, however, differing with the same, the learned trial court has taken cognizance. Petitioners claim clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the general and omnibus nature of

Patna High Court CR. MISC. No.22218 of 2025(2) dt.28-04-2025 3/3 accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 222 of 2018, subject to condition as laid down under Section 482(2) of the B.N.S.S..
