The petitioners apprehend their arrest in registered for the offences punishable under Sections 354A, 379, 34 and other Sections of the Indian Penal Code.
Petitioner no. 1 happens to be elder brother of her husband, petitioner no. 2 is the son of petitioner no. 1 and petitioner no. 3 is the wife of petitioner no. 1. It is alleged that after death of husband of the informant, the accused persons put pressure upon the informant to demand money from her parents and they also harvested the land of paddy crops standing in the name of her husband.
It is submitted that all the allegations are false and
Patna High Court Cr.Misc. No.40502 of 2015 (2) dt.05-10-2015 2/2 concocted. The informant and her daughter filed Title Suit No. 481 of 2005 for partition of the property. The occurrence is said to have taken place on 27.11.2014, but the informant alleged that the occurrence took place since 27.11.2014 to 08.12.2014 and the FIR was lodged on 13.01.2015. It is further submitted that on account of land dispute this false case has been filed only to put pressure. Having considered the facts aforesaid and the fact that the petitioners are close relatives of the informant, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.
10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Shri Awinash Kumar, the learned Judicial Magistrate, 1st Class, Rohtas at Sasaram in Sheosagar P.S. Case No. 11 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
