JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 Petitioner apprehends his arrest in connection with Nawada Town (Kadirganj) P.S. Case No. 336 of 2018 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 326, 307 and 302 of the Indian Penal Code. Allegation as per FIR is that deceased was assaulted by one Munarik Choudhary by spade on his head, due to which he fell down and subsequently died and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that though he is named in the FIR but no specific allegation of assault is attributed against him and he has no criminal antecedent.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.1538 of 2019(2) dt.23-01-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada Town (Kadirganj) P.S. Case No. 336 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
