JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Pasraha P.S. Case No. 67 of 2016 for the offences instituted under Section7 of the E.C. Act.

The prosecution story, in brief, is that on 16.05.2016 at 10.00 A.M. the informant received information with regard to black marketing of rice of P.D.S. System in village-Sondiha and accordingly, inspected the place of occurrence and seized 13 bags of rice of P.D.S. System loaded on a Tempu. It has been further alleged that the villagers told him that the said rice was being carried to be sold in black market from the P.D.S. shop of the petitioner.

Patna High Court Cr.Misc. No.27443 of 2016 (2) dt.12-07-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner is said to have falsely been implicated in the present case. He is a P.D.S. dealer. The present case has been instituted at the instance of the seizure list witnesses, namely, Sanjeev Kumar, Gopal Singh and Ramji Singh. The petitioner has inimical term with the aforesaid persons which is evident from Annexure-2 to the present application.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Pasraha P.S. Case No. 67/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
