The appellant is apprehending his arrest in connection with Hajipur Sadar P.S.Case No.94 of 2012 , registered for offences punishable under Sections 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code and Section 3(2)(v) of SC/ST (Prevention of Atrocities) Act.

Allegation is against one Javed Akhtar that he was collecting money for providing job and licence of Gas and Petrol Pump Agency and did not return the same and on 3.3.2012 Javed Akhtar came to Hajipur and called the informant who came to Hajipur and taken Javed Akhtar and Javed Akhtar stayed in the house of the informant and Javed Akhtar undertook to return the amount but the same has not been returned.

Submission of the learned counsel for the appellant is that the FIR discloses nothing against this appellant, however, his name transpired during the investigation

Patna High Court CR. APP (SJ) No.58 of 2019 dt.02-04-2019 2/2 showing that he was P.A. of Javed Akhtar but there is no allegation against him that he has collected money .

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellants, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ-I, Vaishali at Hajipur in connection with Hajipur Sadar P.S.case No.94 of 2012, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this appeal is allowed and the impugned order is set aside.
