JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 04-09-2015 Heard the learned counsel for the petitioner and the State. The petitioner purchased a piece of land and constructed his house Rear side of the plot is the road of the Police Cooperative Colony. The petitioner wants to use the drainage system constructed on the said road as also for his ingress and outgress. According to him, this was objected by the office bearer of the

Patna High Court CWJC No.7955 of 2011 (2) dt.04-09-2015 2/2 Housing Cooperative Society. According to the petitioner, the road is the government road inasmuch as drainage system was constructed on the said road by the Patna Regional Development Authority.

After hearing both sides, in my view the dispute of such nature cannot be adjudicated in writ jurisdiction of this Court. It appears the petitioner has already ventilated his grievance before the competent / appropriate authority of the Patna Municipal Corporation. The writ application is disposed of permitting the petitioner to ventilate his grievance before the said respondents for consideration and disposal in accordance with law.
