The petitioner seeks bail in connection with Bhabhua P.S. Case No. 155 of 2023 registered for the offence under Sections 25(1-b), a/26 of the Arms Act and 37 of Bihar Prohibition and Excise Act 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2023.

The allegation is that petitioner was drunked and roaming around with one country made pistol.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the allegation, this application for regular bail is allowed.

No.23949 of 2023(2) dt.15-05-2023 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise A.D.J.-IV, Kaimur at Bhabhua in connection with Bhabhua P.S. Case No. 155/2023. The petitioner will visit Bhabhua Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
