JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Sheikhpura P.S. Case No. 465 of 2018, disclosing offences under Sections 147, 148, 149, 323, 307, 353, 379, 427, 337, 338 of the Indian Penal Code, Section 3⁄4 of Prevention of Damage to Public Property Act and Section 40 of BMMC Rule.

Allegation as per F.I.R. is that when the police official was seized some tractors then the petitioner and other miscreants started throwing stone on the police party in order to get the tractors free. Further it appears that the petitioner is accused in two other cases.

Submission of learned counsel for the petitioner is that though he is named in F.I.R., but no specific allegation has been attributed against him.

Having heard both sides, considering the above facts and circumstances of the case and antecedents of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
