JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 Petitioners seek bail in anticipation of their arrest in connection with Rajauli P.S. Case No. 286 of 2017, registered for the offences punishable under Sections 365, 366A and 506/34 of the Indian Penal Code.
Allegation against the petitioners, who are ladies, is of kidnapping of minor daughter of the informant. Submission of learned counsel for the petitioners is that falsity of the case will appear from the fact that the girl had gone with Rs.20,000/- for sewing her clothes, which does not appear to be probable and in her statement under Section 164 Cr.P.C. though she has named these petitioners but nothing has been alleged against them either about kidnapping or any overt

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Rajauli P.S.Case No. 286 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
