ANJANA MISHRA ORAL ORDER 24-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.11.2018 in connection with Excise Case No.1027 of 2018, arising out of Bhabua P.S. Case No.815 of 2018 registered for the offence under Section 30(A) of the Bihar Prohibition of Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner was taken into custody from the house, which is in the joint possession of the petitioner and other brothers from where the alleged recoveries were purportedly made. Learned counsel for the petitioner thus submits that the petitioner may be extended the privilege of bail and he has no criminal antecedent.

No.78912 of 2018(2) dt.24-01-2019 2/2 Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Kaimur at Bhabua, in connection with Excise Case No.1027 of 2018, arising out of Bhabua P.S. Case No.815 of 2018.
