The petitioner has been in custody since 05.03.2019 in connection with P.R. Case No. 191/2019/Special Case No. 2370 of 2019 registered for the offense punishable under Sections 30(a) of the Bihar Prohibition and Excise Act. The allegation against the petitioner is that he was carrying 22.5 liters of country-made alcohol on his head. However, the petitioner has no concern with the same and the alleged recoveries were not made from his conscious possession rather the person who was carrying the same, left it on the path where the petitioner was going through and since the petitioner could not explain the same, he has been taken into custody.
