The petitioner seeks bail in connection with Belaganj P.S. Case No. 318/2018 (G.R. No. 7283/18) instituted for the offences under Sections 304(B)/34 the Indian Penal Code.

On 16.10.2020, this Court had called for a report about the stage of the case. It appears that the Trial Court is vacant and, therefore, there is no substantial progress in the case.

No.26299 of 2020(4) dt.15-01-2021 2/2 However, regard being had to the nature of accusation against the petitioner, I am not inclined to grant bail to him for the present but if there is no substantial progress in the case in the next nine months and which delay shall not be attributable to the petitioner, he may renew his prayer for bail.

This observation has been given keeping in mind that the petitioner is in custody since 09.07.2019. The petition stands disposed of.
