The petitioner seeks bail in Sahebganj P.S. Case No. 348 of 2017, registered for the offence punishable under Sections 366(a), 34 of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused Manoj Kumar, Arjun Kumar and his mother kidnapped the sister of informant on motorcycle and confined her in village situated in forest for four days. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, petitioner's name surfaced in this case. The victim girl in her statement under Section 164 Cr.P.C has stated that she voluntarily returned to her house. The age of victim girl found by the doctor is between 19-20 years. Patna High Court CR. MISC. No.35928 of 2021(2) dt.09-12-2021 2/2 has been granted bail by this Court vide order dated 24.09.2018 passed in Cr. Misc. No. 41771 of 2018. Petitioner claims clean antecedent and he is in custody since 21.09.2020. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, (West) Muzaffarpur in connection with Sahebganj P.S.
