This application for anticipatory bail arises out of Saharsa Rail P.S.Case No. 24 of 2018, disclosing offences under Sections 366 and 34 of the Indian Penal Code. The petitioners are father and mother of the coaccused Priyanshu Kumar @ Binit Kumar. On perusal of the FIR, it transpires that the informant, who is the husband of the alleged victim, is said to have kidnapped the victim. Earlier also, an FIR was registered against the said co-accused Priyanshu Kumar @ Binit Kumar by the informant in which the police had submitted final report as a mistake of fact.

Considering the fact that the petitioners are father and

No.80354 of 2018(2) dt.24-01-2019 2/2 mother of the main accused Priyanshu Kumar @ Binit Kumar and it appears that they have been implicated for their relationship with the main accused, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the A.C.J.M. ® Railway Khagaria in Saharsa Rail P.S. Case No. 24 of 2018, corresponding to G.R.(R) N164 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
