APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 01-05-2019 The present petition has been filed for modification of the order dated 23.01.2019 passed in Cr. Misc. No. 50876 of 2018.

2. Learned counsel for the petitioner submits that owing to extenuating circumstances he could not surrender within the stipulated period as the petitioner is a cancer patient undergoing treatment at Medanta Hospital at Gurugram and as such the petitioner has sought extension of time.

3. For the reasons stated above, time for surrender and furnishing bail bond in terms of order dated 23.01.2019 in Cr. Misc. No. 50876 of 2018 is hereby extended by a period of six

Patna High Court CR. MISC. No.27578 of 2019(2) dt.01-05-2019 2/2 weeks from today.

4. Having regard to the medical condition of the petitioner and as further prayed on his behalf, para-5(iii) of the order dated 23.01.2019 passed in Cr. Misc. No. 50876 of 2018 shall be treated as modified to read as follows - " The petitioner shall be well represented in Court each and every date during trial except as and when directed by the learned Court to be physically present, and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned court concerned."

5. The petition stands allowed only to the extent above.
