Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code, registered in connection with Suryapura P.S.Case No. 74 of 2019.

The informant is the first wife of the petitioner. As per allegation, when she wanted to enter into the house, the petitioner resisted and assaulted her. She sustained injury. The learned counsel for the petitioner has submitted that though it is admitted fact that the informant is the first wife of the petitioner but she has solemnized her second marriage with Anil Sah and this fact has been mentioned in paragraph no.7 of the bail petition that she solemnized marriage with Anil

Patna High Court CR. MISC. No.36111 of 2021(3) dt.19-07-2022 2/2 Sah in March, 2020. He has also submitted that the injuries suffered by informant are simple in nature and the petitioner is a person of clean antecedents.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Lal Bihari Paswan, J.M. 1st Class, Bikramganj, Rohtas in connection with Suryapura P.S.case No. 74 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
