Petitioner apprehends his arrest in connection with Marhowrah PS case no. 359 of 2016 registered for the offences punishable under Sections 188, 308 of Indian Penal Code and Section 47(A), 54 of Bihar Excise Act.

The informant raided an open field and recovered 50 liters of country made mahua liquor. The informant alleged that petitioner was preparing country made liquor and selling the same. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner is not the owner of the place.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to

Accordingly, let the abovenamed petitioner, in the event of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-II, Saran at Chapra in connection with Marhowrah PS case no. 359 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
